DEBENHAMS BEAUTY CLUB COMMUNITY TERMS OF USE

 

Thank you for your interest in the Debenhams' Beauty Club Community (the "Community"). Debenhams is pleased to receive your contributions.

 

This service is subject to the terms and conditions set out on this page and by using the Community you confirm your agreement to these terms and conditions. We respect, and expect users to respect fellow Community members by complying with these terms.

 

  1. Welcome to the Beauty Club Community

Debenhams provides this Community as a service to help our customers exchange ideas, tips and information related to all things Beauty.

You can access the Community as a Guest User or a Registered User. Guest Users will only be able to see the content on the site, but won't be able to interact with the Community, such as to create posts, comment or like other posts or receive Community rewards. You will need to become a Registered User in order to set up a profile and fully interact with the Community.

 

  1. Membership and Eligibility

Membership to the Community is limited to individuals only and is limited to one account per individual. Employees, officers, directors, agents and representatives of Debenhams and its affiliates are eligible for membership but may be excluded from certain promotions.

You must be a resident of the United Kingdom to join the Community. We want to be sure our users are protected and therefore you must be at least 16 years of age to join the Community.

When you join the Community, you will be asked to create an account on Debenhams.com. In order to take advantage of the Beauty Club points rewards from time to time offered on the Community, you will also need to be a Debenhams Beauty Club member. Debenhams Beauty Club is a reward scheme that allows you to collect and spend points across over 200 beauty and fragrance brands at Debenhams, both in store and online.   1. Your Profile and Posts

When you create your profile, please be aware that this is a publicly available site and that both Guest Users and Registered Users can view the information you upload, including any photos and videos you upload.

 

Please make sure you do not post anything which you do not want to be made public. We have set out below what Guest Users and Registered Users can view from your profile when they access the Community for your information:

 

Seen by you and everyone else on your profile

·         Profile photo or Beauty Club Community default avatar

·         Nickname

·         Community Biography on your profile

·         Beauty community rank

·         Beauty community badges

·         My latest contributions

·         My photos

Seen only by you on your profile

·         Private notes

 

How to post and edit or delete posts - we have prepared detailed FAQs to explain how you can post on the Community and edit or delete your posts. Please see here for details.

 

You are responsible for any comments or content that you post on our Community (together referred to as the "User Posting"). Your User Posting should be written in English. You must ensure that your User Posting does not include any material which:

  • includes any personal data which you wouldn't want to be made public, such as your full name, address, workplace, phone numbers, email addresses or videos or photos which are intended for your eyes only;
  • is offensive, abusive, discriminatory, harassing, malicious, threatening, blasphemous, racist or defamatory;
  • is indecent or obscene;
  • violates the intellectual property, privacy or other right of any other person;
  • is illegal or encourages any action which is illegal;
  • advertises any other person, products or services, or has the appearance of so doing;
  • is irrelevant or unsolicited material (such as spam);
  • links to inappropriate websites; or
  • contains viruses or other malicious code.

 

It is your responsibility to ensure that your User Posting is: (i) accurate, where it states facts; (ii) is genuinely held, where it states opinions; and (iii) you have obtained all third party consents required to make the User Posting.

 

User Postings are the sole responsibility of the user who posted and Debenhams cannot accept responsibility for any comments made on our Community or on any external sites, such as Facebook. The views and opinions expressed in User Postings are the views of those users. We do not endorse any User Postings and are not in any way responsible for the User Postings, which may not reflect our own views. We do not accept any responsibility to vet, monitor or moderate User Postings.

 

We retain the right at all times to delete or edit any User Postings at our complete discretion without providing any explanation or to republish any comments, but we are not obliged to do so.

  1. Links to Third Party Websites

You must make sure that any third party websites for which you post a link on our Community do not contain any of the material prohibited above. We do not accept liability for the content of third party sites or resources. Use of third party sites are not covered by our terms and conditions or by our Privacy Policy and will be governed by the site's own terms and policies which you are advised to check.

 

  1. Content and Operation of Community

We aim to ensure that all content we create and publish on our Community is accurate in all material respects at the time of publishing. However, all content is subject to change and while we will always seek to reflect the latest position, we cannot guarantee this and accept no liability in respect of this.

 

Notwithstanding the above, any content on the Community is not intended to amount to advice on which reliance should be placed. We make no guarantees as to the accuracy, completeness, reliability or otherwise of any of the content on our Community including any User Postings. Content, such as pricing and other information, may be incorrect or out of date.

 

If our Community is unavailable due to technical error or other reason, we will seek to resolve this as soon as possible. We make no representation or warranty and accept no liability as to the Community's operation or availability.

 

Users of the Website are prohibited from downloading, republishing, retransmitting, or reproducing any image file incorporated on the Website as a stand alone file, or from any other use of such images.

 

  1. Earning Debenhams Beauty Club rewards

Debenhams may, from time to time, offer Beauty Club points as rewards for your interactions on the Community. These rewards are provided in Debenhams absolute discretion and no correspondence will be entered into.

 

You must be a Beauty Club member to take advantage of these rewards. Please see our Membership and Eligibility section above.

 

Any Beauty Club points awarded are subject to the terms and conditions of the Beauty Club scheme which can be found here: https://www.debenhams.com/wcsstore/DebenhamsUKSite/faq/legal_information/beauty_club_gift_cards_and_.... This includes details on the redemption and expiration of the Beauty Club points.

Beauty Club points awarded by Debenhams are non-transferable, non refundable and non negotiable. No cash alternative is available for any Beauty Club points awarded. Debenhams reserves the right to cancel any promotion or reward of points, cancel or refuse any individual's reward and amend the terms and conditions of any promotions at any time.

 

  1. Moderator Guidelines for the Community

As a responsible retailer, Debenhams will from time to time monitor the User Postings on the Community. We particularly make every effort to review and approve photos and videos that you post before they are uploaded to the Community. We will try to give you a gentle steer if we believe a conversation is going off-topic or edit User Postings that have minor issues (and we aim to tell you why we've done this), however we reserve the right in our absolute discretion to remove or lock User Postings and to temporarily suspend or ban and delete your account if we determine you are violating these Terms of Use or acting in a way that is not appropriate for the Community. We've set out some details of when we do this below.

 

When do you remove User Postings?

Debenhams may remove User Postings that we determine violate these Terms of Use, our User Guidelines and/or applicable laws or regulations, or if we believe these User Postings are inappropriate for an online community.

 

Examples of when we may remove your User Posting include, but are not limited to:

  • Your User Posting shares personal information such as your home or work address, telephone number or email address
  • Your User Posting intentionally or unintentionally encourages negativity on the Community
  • Your User Posting contains inappropriate, offensive or abusive language which may or may not be targeted towards another member
  • Your User Posting contains imagery that may be deemed offensive
  • We ask you to change your User Posting and you don't do so within the specified timeframe.
  • Your User Posting doesn't appear to be genuine (e.g. it appears fabricated)
  • Your User Posting violates other people's or companies' rights, including intellectual property rights, rights of privacy/confidentiality and/or personality rights.
  • Your User Posting is of a marketing nature or has marketing purposes.
  • You have created multiple profiles or spamming accounts
  • You have linked to a third part website that sells counterfeit goods
  • We need to delete your user profile (see below) which means that by default, your User Posting(s) attached to that profile will also be deleted.

When do we block your account and what does that mean?

We may block your account if you are misusing the Community site or services. This can include, but is not limited to, creating accounts for spamming purposes, threatening or abusive behaviour towards another member, offensive or illegal content, linking to counterfeit websites, or continuous violation of these Terms of Use or User Guidelines.

 

If we block your account, it will not be possible for you to sign in to the Community and use the services, including uploading User Postings. Your profile will still exist and your User Postings will stay online, but you will be unable to use the Community. If your account is blocked and you want to delete your profile or reviews, you can contact our Customer Contact Centre and we'll assist you.

 

On occasion, users who violate our terms or guidelines will need to have their Community access removed temporarily or permanently (see below).

 

When do we delete your profile and account and/or ban you from the Community?

We reserve the right to delete your profile and account or ban you from the Community if we believe that you are violating or have violated our Terms of Use, User Guidelines and/or applicable laws, or if your profile is offensive or inappropriate.

 

Examples of when we may delete your user profile and account include, but are not limited to:

  • It is not attached to a valid email address, including if the provided email address has expired or is no longer accessible by you. We need you to sign up to our services using a permanent, personal email address because we may need to get in touch with you. This means that we do not accept the use of temporary or disposable email addresses. If you have used such an email to create an account then we will delete your user profile and account.
  • Your user profile contains an offensive or inappropriate picture or username.
  • Your user profile or account has been used to create fabricated reviews or otherwise misuse our Community site or services.
  • You have created multiple user profiles. You may only have one user profile on the Community. If you create more than one user profile we will ask you which one you want to keep and delete the other profiles. If you don't get back to us within the specified timeframe, we will remove all but one of your profiles at our discretion.
  • Using your account to post offensive and abusive User Postings towards other members
  • Using your account to post illegal content
  • Using your account to promote third party websites that sell counterfeit goods

If your user profile and account is deleted, the User Postings attached to that user profile and account will also be deleted.

 

  1. Reporting a Comment or Content and Customer Complaints

If you see any comments on our Community which you feel contravene these Terms of Use, or any content which you believe is incorrect, please report this using the "Report Inappropriate Content" feature on each post to flag the comment to our Moderation team. If you have any questions regarding moderation or the Community or if you have any complaints, please contact our customer contact centre on 0844 800 8877.

 

  1. Breach of these Terms of Use

If you breach these Terms of Use, you may be prohibited from posting on our Community in the future and/or we may take further legal action against you.

 

  1. Intellectual Property

All copyright, trademarks, design rights, patents and other intellectual property rights (registered and unregistered) in or in connection with our Community is our property or the property of our licensors. All rights are reserved.

 

You may only use the Community for your personal use and you may not use the any part of the Community for any other purpose. Nothing in these Terms of Use grants you a right or licence to use any copyright, trademark, design right, patent or other intellectual property on or relating to the Community. Without limitation, you do not have any rights to reproduce, modify, transmit, display, publish, sell, create derivative works or distribute any part of the Community without obtaining our prior written consent.

 

You grant us an irrevocable, royalty-free, worldwide licence to use the intellectual property in any content that you post on or in connection with our Community. This includes any information about yourself that you choose to submit or post as part of your Beauty Community membership or that relates to your activities in the Beauty Community such as: Nickname, number of followers, personal characteristics such as 'Biography', 'Skin care, make up, fragrance wants', groups, conversations, photographs and videos. By posting content on our Community, you warrant that you either own or otherwise control all of the rights to that content, including but not limited to the right to post such content.

 

Knowingly posting content on this web site that contains the copyrighted work of others without the owner's consent is strictly prohibited. If we receive a valid notice that content posted on this site infringes or is likely to infringe the copyrights of others, we will promptly remove such content. If you believe that your copyright is being infringed on this site, please send notice to our Customer Contact Centre with the following information:  (a) an electronic or physical signature of the copyrighted work owner (or authorized person); (b) a description of the copyrighted work, including the URL where this infringing content is available or a copy of it; (c) your contact details: email address, telephone and address; (d)  a statement in 'good faith belief' that the work is not authorized by the copyright owner; and, (e) a statement by the person who sends the takedown notice that the information you send in the notice (above information) is accurate and that you are either the copyright owner or you are authorized to act on copyright owner's behalf.

 

  1. Data Protection

In using our Community, you agree that we may process any information which you provide in accordance with our Privacy Policy.

 

You will sign up to the Community via an existing or new Debenhams account on Debenhams' website, however Debenhams uses a third party; Lithium, to host the Community site itself. Personal information that you provide in the Community will only be processed by Lithium (on behalf of Debenhams) to the extent that it is required for the operation of the Community site and if we stop using Lithium, we will require them to remove or anonymise your information.

 

Lithium may use cookies on the Community site in order to enhance your use of the Community. A cookie notice will be displayed when you sign up to the site which will tell you more information about these cookies. Please note that we're not responsible for the content of external websites.

 

Lithium processes data primarily in the EEA for companies based in the UK/EEA like Debenhams, however they do provide customer support and conduct engineering work that might sometimes require limited access to data from outside of the EEA, such as Lithium office locations in the U.S. and India.  For more information see https://community.lithium.com/t5/Policies-and-Guidelines/What-companies-are-subprocessors-to-Lithium.... Lithium ensures that any such parties will comply with security and data privacy standards at least as protective as those that Lithium commits to Debenhams, and has contractual provisions in place with those parties.

 

  1. Changes to these Terms of Use

We may from time to time change, modify, add to or replace any part of these Terms of Use. Please visit this page regularly to check for any changes. Your continued use of the Community after any changes have been made constitute your acceptance of the changes.

 

  1. Governing Law

These Terms of Use and the Community are governed by and construed in accordance with the laws of England and Wales. You further expressly consent and agree to submit to the exclusive jurisdiction of the courts of England and Wales.
